The Intellectual Property Practice provides a full range of commercial/transactional services covering all aspects of intellectual property and information technology law, including: technology transfer and computer software patent and trade secret licensing; intellectual property due diligence for M&A and capital market transactions; trademark, merchandising, and copyright licensing; client counselling in all facets of intellectual property matters; transactions in digital media and electronic distribution; franchising; issues relating to breeders’ rights; and enforcement of intellectual property and related rights before judicial and administrative tribunals, including border control measures and anti-counterfeiting measures. As such, the intellectual property team is involved in most of the firm’s transactional activities.
The practice’s lawyers also provide clients with services that are usually reserved to boutique intellectual property law firms, such as trademark filing and prosecution; civil claims for trademark, copyright and patent infringement; appearances before the Commissioner of Patents, Trademarks and Designs in various cancellation and opposition procedures, internet and domain name protection and retrieval; representation of clients in negotiations with copyright collection societies; and protection of intellectual property rights in various settings, such as employer-employee, development, evaluation, and independent contractor relationships.
Due to the international nature of its clients, the Intellectual Property practice manages the worldwide IP portfolio of a number of major multinational corporations and is well-known for its unique specialty in handling trademark matters within the gaming industry. In addition, the team is vastly experienced in dealing with cybersquatting and domain name disputes all over the world.
The Intellectual Property practice is increasingly involved in IP litigation at both the court and administrative levels. The team works closely with Herzog Fox & Neeman’s Litigation and Dispute Resolution department to provide clients with a true one-stop-shop intellectual property litigation capability.
