Delaware’s Personal Data Privacy Act Compliance Playbook
23 October 2025
Delaware’s Personal Data Privacy Act, effective January 2025, introduces new obligations for businesses processing personal data, emphasizing transparency, accountability and responsible data management.
Covered businesses must enable individuals to access, correct and delete their personal data, and provide clear mechanisms to opt out of certain processing activities. The act further requires businesses to maintain transparent data practices, restrict data use to disclosed purposes and implement structured compliance measures to safeguard consumer privacy.
Many companies incorporated in Delaware for corporate or other legal reasons may fall within the new act’s scope, as its applicability thresholds are comparatively low. It is therefore essential for businesses to assess carefully whether they are subject to the act. Importantly, the right to cure violations expires on 31 December 2025, after which the Delaware Attorney General may initiate enforcement actions without offering an opportunity to cure non-compliance.
We are pleased to present our compliance playbook, which is designed to help organizations determine whether the law applies to them, understand their key obligations and prepare for compliance. Our team is here to assist with assessing applicability, developing compliance strategies and implementing effective privacy governance frameworks.
