“Enforcement activity of the Attorney General in the State of Massachusetts is one of a series of enforcement steps being taken by the US and European authorities against the use of sensitive information – such as medical information or information regarding children – or dubious practices for advertising purposes” explains Adv. Yosefi, Co-head of the Technology and Regulation Department of Herzog, Fox and Neeman. “The trend is expected to gain traction with the introduction of European reforms in privacy law next year whereby there will be specific reference to cases such as these. These steps will not only be applicable to the publishers themselves, but against the digital advertising networks and in turn, fines will rise”.
