The EU Artificial Intelligence Act
11 March 2024
Dear client and friends,
On 13 March 2024, the European Parliament approved the Artificial Intelligence Act (the “AI Act“).
The AI Act stands as a pioneering legislative framework, marking the world’s first cohesive and harmonized approach to regulating artificial intelligence.
To assist with understanding and navigating between the novel requirements under the AI Act, we are pleased to share Herzog’s Artificial Intelligence Act Guide. In this guide, we provide explanation about the act’s scope, key practical takeaways and useful insights.
The AI Act is now pending its anticipated final approval by the Council of the European Union. Then, it will enter into force 20 days after publication in the Official Journal.
The provisions concerning prohibited AI systems will start to apply 6 months following entry into force. Other significant provisions – concerning general purpose AI models, governance, confidentiality, notifying authorities and notified bodies, as well as penalties – will start to apply 12 months following entry into force. The rest of the provisions will start to apply either 24 months following the entering into force of the AI Act, or 36 months in case of some provisions concerning high-risk AI systems subject to EU product safety.
Companies developing, providing, distributing and using AI systems and models in the EU should evaluate their exposure to this novel regulatory framework.
