The legal landscape surrounding data protection in the United States continues to evolve and expand over the past couple of years. 

Since the beginning of 2024, 2 US states (New Jersey and New Hampshire) have enacted comprehensive general privacy laws, joining the 12 states that have enacted such laws in recent years, and other states’ privacy laws are on the way.

These developments may result in a complex and fragmented regulatory environment. While the various laws share significant similarities in their key concepts and principles, they vary in the particular rights granted to data subjects and their scope.

Recognizing the challenges that this fragmented landscape presents, we have published our comparative guide, which simplifies the differences between the various US states’ privacy laws in relation to data subject (consumer) rights and a couple of additional key requirements. The previous version of the guide was previously published in July 2023, and we are happy to now share the updated guide, adding reference to the 2 new laws and additional regulatory developments in the previously enacted laws.
